Transgender activist Nury Martinez has become a fixture in her community and the online activism group #NoMakeupNoCount. But the Florida transgender woman could soon face a judge who could decide whether she’ll stand trial on misdemeanor trespass charges.

Martinez was arrested in early April after a video of police officers responding to a call about a man who was trespassing in a Miami-area bathroom went viral, and she was charged with misdemeanor trespass charges.

The Miami Police Department opened an investigation into an incident involving the 19-year-old man who was arrested, according to a letter written to Martinez by Dade County District Attorney Richard Brown.
